Migros Federation of Cooperatives / m4music: General Terms and Conditions

These General Terms and Conditions (hereinafter “GTC”) apply to all contractual relationships between Migros Federation of Cooperatives / m4music (hereinafter the “Organizer”) and festival visitors.

1. General

1.1. By purchasing a ticket, the purchaser or holder (hereinafter “ticket purchaser”, “ticket holder” or festival visitor) accepts the Organizer’s GTC. If the ticket purchaser passes tickets on to third parties, they are obliged to make these GTC known to such third parties, and those third parties must accept the GTC.

1.2. Festival visitors are subject to the opening hours communicated for the respective category. The Organizer reserves the right to change the opening hours without prior notice. The Organizer assumes no liability for delays in admission.

2. Tickets

2.1. Tickets for the m4music Festival may be purchased via the Organizer’s official ticket shop (Professional Passes) as well as via the See Tickets ticketing platform (Show Tickets). Show Tickets and Professional Passes are hereinafter collectively referred to as “tickets”.

2.2. The GTC of See Tickets apply to the purchase processing of Show Tickets via the See Tickets platform. See Tickets is responsible for the proper execution of ticket purchases via its platform, including the delivery of tickets. The Organizer assumes no liability for technical or organizational problems that may arise when using See Tickets.

2.3. The Organizer operates its own ticket distribution organization for the sale of Professional Passes. By purchasing a Professional Pass via the Organizer’s ticket distribution system, a contractual relationship arises exclusively between the ticket purchaser or ticket holder and the Organizer. The website and the ticket system are protected by copyright and other rights. All rights thereto, including ownership and/or usage rights, are held by the Organizer and/or its suppliers/licensors.

Ticket order, use of the online ticket shop, personal data

2.4. Ticket purchasers make their selection via the website (ticket shop), which is displayed in the shopping cart. By confirming the order, the ticket purchasers submit a binding offer to purchase the selected tickets.

2.5. Ticket purchasers are obliged to provide all information required during the ordering process completely and correctly. It is solely the responsibility of the ticket purchasers to place ticket orders in time before the date of the event via the ticket shop (hereinafter “online order”).

2.6. For online orders, the ticket purchaser must identify themselves in the ticket shop with their email address and password (hereinafter “access data”; the corresponding user account: “online account”). If the ticket purchaser does not yet have an online account, they will be prompted during their first online order to register in the webshop with the required details. The access data provided to the ticket purchaser are intended for personal use and must be treated confidentially. All online orders made via the online account are attributed to the ticket purchaser as the account holder and are binding for them.

2.7. Ticket purchasers acknowledge and agree that the Organizer obtains knowledge of their data in connection with the online ticket shop service. The processing of personal data is subject to the Migros Group privacy policy, available at privacy.migros.ch.

Ticket delivery, print@home

2.8. Show Tickets are not personalized. Professional Passes are personalized.

2.9. Multi-day tickets may not be split between different persons.

2.10. Ticket purchasers receive the tickets by email. They are also available at any time in their account in the ticket shop and can be downloaded. The ticket may be printed or presented digitally on a smartphone. Ticket purchasers acknowledge that it is their own responsibility and risk to have all necessary technical equipment required for receiving and printing or displaying print@home tickets.

2.11. Each purchased festival ticket entitles the ticket purchaser to one entry authorization only. Any duplication, copying, alteration or imitation of the print@home ticket is expressly prohibited. In the event of loss or damage of a print@home ticket, ticket purchasers may reprint the ticket, while being aware of the possibility of being denied entry to the event under the conditions set out in clause 2.12. The damaged print@home ticket must be destroyed immediately. Ticket purchasers are aware that blocking a print@home ticket is not possible. In this case as well, the provisions of clause 2.12 apply.

2.12. The Organizer may refuse entry to the event if multiple printouts, reproductions, copies or imitations of a print@home ticket are in circulation and one ticket holder of a printout, copy or imitation of the respective print@home ticket has already been granted entry. In particular, the Organizer is not obliged to verify the identity of the ticket holder with the ticket purchaser or to verify the authenticity of the print@home ticket. If a holder of a print@home ticket is refused entry for this reason during access control, there is no entitlement to a refund of the fee.

Payment

2.13. For online orders, payment is made either by charging the credit or debit card specified during the ordering process (MasterCard, Visa), via PostFinance payment methods (PostFinance Card, PostFinance e-finance) or via TWINT. It is at the discretion of the Organizer to decide which payment methods are accepted and whether/when tickets that have not been paid for on time are released again for sale.

Prohibition of resale or raffles

2.14. The purchase of tickets for the purpose of resale (trading) is prohibited. The Organizer carries out appropriate checks and may block and declare invalid any tickets acquired for resale or offered at inflated prices. Criminal proceedings remain reserved. Professional Passes are personalized and non-transferable.

2.15. Tickets may only be raffled or otherwise passed on for advertising purposes with the prior written consent of the Organizer. The Organizer carries out appropriate checks and may block and declare invalid any tickets distributed by raffle or for promotional purposes.

Wristbands

2.16. Show tickets can be exchanged for a wristband at the check-in desk from 6:00 p.m. The wristband entitles the holder to access all concerts, subject to capacity. Early arrival is recommended.

2.17. Professional Passes can be exchanged for a wristband at the check-in desk from 10:00 a.m. The wristband entitles access to all concerts (subject to capacity) as well as to professional events (in some cases only with prior registration or by invitation).

2.18. The festival ticket is checked (barcode or QR code) at the Organizer’s official exchange points and exchanged for a wristband. The wristband, which must be worn tightly closed on the wrist, entitles entry to the restricted festival area (during the period stated on the ticket). Damaged wristbands or wristbands not worn tightly on the wrist do not entitle access to or presence on the festival grounds. Lost and damaged wristbands will not be replaced. Wristbands may not be transferred and entitle only one person to access the festival.

2.19. Entry to the festival is permitted from the age of 16. Persons under 16 years of age may only enter when accompanied by a legal guardian who is of full age. Proof of legal guardianship is required. The Organizer conducts age checks on site during the exchange for festival wristbands. Visitors must prove the age of children or youths with valid ID or passport and present it unprompted during the exchange.

3. Measures relating to communicable diseases

3.1. The ticket purchaser acknowledges that the Organizer must comply with official regulations relating to measures to combat communicable diseases and that these regulations may be adjusted between the time of ticket purchase and the event.

3.2. The Organizer is therefore entitled, even after ticket purchase, to restrict access to the festival grounds or parts thereof or to make such access dependent on the fulfillment of certain conditions. Official requirements are minimum standards. The Organizer may impose stricter admission rules at its discretion and may in particular require, for access to the festival grounds or parts thereof, a valid certificate, proof of vaccination or recovery, provision of contact data for contact tracing purposes, presentation of an identity document, wearing of hygiene masks, or other suitable measures.

4. Admission and stay

4.1. Information on applicable admission rules is published by the Organizer on the website (www.m4music.ch) and updated continuously. Ticket purchasers and visitors are obliged to inform themselves in good time about the applicable admission rules at the time of the event.

4.2. The ticket purchaser acknowledges that these admission rules may be adjusted by the Organizer at any time after ticket purchase, in particular for safety reasons, and agrees that if the rules are not complied with, they have neither a right to admission nor to a refund of the ticket price paid.

4.3. The Organizer’s security personnel carry out security and admission checks, including bag searches, at all official entrances and along and within the festival area during the entire duration of the event.

4.4. Security personnel have the right, at their discretion, to refuse entry to the restricted festival area for important reasons or to remove persons from the premises. Non-compliance with these GTC may constitute an important reason.

4.5. Festival visitors must comply with the instructions of the security personnel. Failure to do so will result in expulsion from the festival grounds for the remainder of the event. The Organizer expressly reserves the right to take further legal action.

4.6. The Organizer is not liable for lost or stolen items.

4.7. The Organizer and food and beverage providers charge a deposit on tableware, cups, and drink containers. The deposit value is credited to the cashless card upon return at designated return points and bars. Visitors acknowledge that organized collection of deposit items by individuals or organizations is prohibited. The system accepts at most 10 more deposit items than were purchased with the cashless card during the festival. The Organizer collaborates with a tax-exempt organization that collects deposit items and receives the deposit value as a donation.

5. Cancellation, postponement, interruption or termination due to force majeure

5.1. “Force majeure” means any serious, unforeseeable and extraordinary cause preventing contractual performance, beyond the control of the affected party, including in particular: fire, explosions, natural disasters (such as floods, earthquakes, drought), currency crashes, war and warlike events, unrest, epidemics and pandemics, embargos and government restrictions (including decrees or other actions restricting freedom of movement or economic activity). Strikes and other labor stoppages are excluded. In case of cancellation or postponement due to force majeure, a time window for claiming ticket value will be communicated. From announcement of the official process, ticket purchasers have 60 days to choose either a refund (max. 90% of original value) or a credit note (100% transferred to the next edition). If the event is also affected in the following year, the procedure repeats.

5.2. In the event of interruption or termination of the festival due to force majeure, there is no entitlement to return tickets, refunds, or exchange for the next edition. An interruption is any temporary suspension after doors open; termination is a complete cessation without resumption after doors open.

6. Concerts and program

6.1. The Organizer reserves the right to change the program without prior notice. No claims for compensation can be made for artist cancellations, schedule changes, performance times, stage changes, etc., and the Organizer rejects all liability to the extent permitted by law.

6.2. The Organizer has no influence on concert content. Due to volume or lighting, there is a risk of hearing or health damage. Free earplugs are provided. Liability is excluded to the extent permitted by law.

6.3. The festival generally takes place in all weather conditions; cancellation only occurs if safe execution is not possible.

6.4. Travel to and from the festival is the visitor’s responsibility. The Organizer excludes all liability.

7. Payment methods

7.1. The festival is cashless. All m4music sales points accept common debit/credit cards, Postcard and TWINT. At Moods and m4music Bistro in LaSalle, cash is also accepted.

8. Audio, video and photo recordings

8.1. Professional recordings of performances require prior permission; private recordings are permitted.

Photographs taken by the organiser and third parties

8.2. The Organizer, media, and partners produce and publish recordings. By attending, visitors consent to being recorded and to use without compensation.

9. Liability

9.1. To the extent permitted by law, any liability of the Organizer for its own conduct, for the conduct of its auxiliary persons, and for the conduct of third parties is excluded. In particular, the Organizer shall not be liable for damages that were caused by or arose through third parties (e.g. festival visitors, operators of food stands, market stall operators, etc.).

10. Communication and Data Protection

10.1. By purchasing tickets, the ticket purchaser agrees that the Organizer may use the email address for sending newsletters. The ticket purchaser has the right to unsubscribe from the newsletter at any time and to withdraw their consent. The email address will only be passed on to third parties insofar as this is necessary for the provision of the service. The processing of personal data is subject to the privacy policy of the Migros Group, available at privacy.migros.ch.

10.2. By obtaining a ticket in the ticket shop, the ticket purchasers agree that the Organizer may use the email address before and during the event to send all important visitor information and after the event to send a link for participation in a survey.

11. Professional Pass & Professional Database

11.1. The Professional Pass enables professional music creators to access special offers of the m4music Festival.

11.2. The discount for the Professional Pass as well as the requirements for obtaining it are regulated in the Supported Professional Pass regulations. These can be viewed on the official website of the festival at www.m4music.ch/more/professionals.

11.3. By applying for the Professional Pass, applicants agree to be included in the Professional Database of the m4music Festival. The Professional Database serves networking within the music industry and is managed in accordance with the privacy policy of the Migros Group, available at privacy.migros.ch.

11.4. There is no entitlement to a discount for the Professional Pass.

12. Final Provisions

12.1. These GTC of the Organizer form an integral part of the contract concluded with the purchase of a ticket. The Organizer reserves the right to amend these GTC at any time. The amendments shall be deemed accepted unless they are actively objected to within 30 days of their publication. The GTC are available in their current version at www.m4music.ch/more/agb.

12.2. The exclusive place of jurisdiction for all disputes arising from and in connection with these GTC is Zurich. All relationships between the Organizer and the festival visitors are governed exclusively by Swiss law, with the complete exclusion of conflict-of-law provisions as well as the provisions of the Vienna Convention on the International Sale of Goods (United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980).
